SMS, Email, and Automated Voice Alerts Terms of Use

Effective Date: October 1, 2015

Your access to, and use of, the mobile communication tools and text messaging services (collectively, "SMS Texting") is subject to the following Terms of Use and all applicable laws and regulations. By typing "Y" (Yes), or otherwise accessing and using SMS Texting, you accept, without limitation or qualification, these Terms of Use and acknowledge and agree that you are 18 years of age or older.

SMS Texting provides on-the-go access to important account and service related information. The number of messages you will receive is dependent upon the type of alert selected and frequency of available information requested, but you can expect to receive approximately one message per month for each account related notification that you enable.  While there is no direct cost to the public imposed by Citizens Energy Group to utilize any SMS Texting (including text notification deliveries), standard data fees and text messaging rates may apply based on your plan with your mobile phone carrier. As mobile access and text message delivery is subject to your mobile carrier network availability, such access and delivery is not guaranteed. You may "opt-out" or "cancel" text delivery at any time by texting STOP to 56141 or by adjusting your settings in your MyAccount profile online at www.citizensenergygroup.com. You also have the ability to temporarily discontinue your participation in the text program by texting PAUSE to 56141. For further details on use text "HELP" to 56141.

Citizens Energy Group reserves the right to modify these Terms of Use at any time and will post such changes online at www.citizensenergygroup.com/Alerts-Terms-of-Use. By continuing to use the service after we post any such changes, you agree to be bound by the modified terms. If you do not agree to any change, you must immediately stop using SMS Texting. Please review the Terms of Use regularly for updates and changes.


SMS Texting Terms of Use

You may text a keyword (REGSTOP, PAUSERESUME, BAL) to 56141to receive information about your account, subject to the following Terms of Use of Citizens Energy Group.

Terms and Conditions

Your use of SMS Texting is pursuant to a limited, non-exclusive, revocable license and is subject to Citizens Energy Group's privacy policy and Terms and Conditions which may be amended periodically by Citizens Energy Group. You agree that you have read and will comply with Citizens Energy Group's Terms and Conditions. If you do not agree, you may not set up or use SMS Texting.

Cost of Participation

While SMS Texting is complimentary and requires no purchase or fee for participation, message and data rates may apply, and may be billed on your mobile phone bill or other internet or data provider bill. Check with your carrier and/or data provider for details.

Device Compatibility and Eligibility

SMS Texting only functions on certain devices and operating systems. You acknowledge that future operating system upgrades to your device may or may not be compatible with SMS Texting. You further acknowledge and agree that SMS Texting content is transmitted unencrypted and that eavesdropping of wireless communications, including SMS Texting, by third parties is possible.

NO WARRANTIES

WE DO NOT GUARANTEE THAT THE USE OF SMS TEXTING WILL MEET YOUR PERFORMANCE REQUIREMENTS OR BE UNINTERRUPTED OR ERROR-FREE. WE MAKE NO WARRANTIES OR REPRESENTATIONS AS TO THE USE OR RESULTS OF USE IN TERMS OF SECURITY, DATA PRIVACY, DATA LOSS, CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. WE WILL NOT CORRECT ANY ERRORS RELATED TO YOUR USE OF SMS TEXTING. YOU ASSUME ALL RISKS AS TO THE QUALITY AND PERFORMANCE OF SMS TEXTING, INCLUDING BUT NOT LIMITED TO HEALTH RISKS. YOU ACKNOWLEDGE AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DEATH, PERSONAL INJURY, OR ENVIRONMENTAL DAMAGE YOU CAUSE TO YOURSELF, OR OTHERS, BY YOUR USE OF SMS TEXTING.

SMS TEXTING IS PROVIDED TO YOU "AS IS," AND TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. NO STATEMENTS FROM CITIZENS ENERGY GROUP OR ITS EMPLOYEES, DEALERS OR AGENTS MAY INCREASE THE SCOPE OF THE ABOVE WARRANTIES OR CREATE ANY NEW WARRANTIES. IF THIS DISCLAIMER IS INVALID UNDER APPLICABLE LAW, ANY IMPLIED WARRANTIES ARE LIMITED IN DURATION TO THIRTY (30) DAYS FROM THE DATE THAT YOU FIRST INSTALL OR USE SMS TEXTING.

LIMITATION ON LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT CITIZENS ENERGY GROUP AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, CONTRACTORS, CONSULTANTS, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, EVEN IF CITIZENS ENERGY GROUP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE SMS TEXTING, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, STATEMENTS OR CONDUCT OF ANY THIRD PARTY REGARDING SMS TEXTING, OR ANY OTHER MATTER RELATING TO SMS TEXTING.

Termination

Citizens Energy Group reserves the right, in its sole discretion, to cancel or suspend any or all of SMS Texting, in whole or in part, for any reason, with or without notice to you.

Applicable Law and Disputes

These Terms of Use and our relationship with you regarding SMS Texting are governed by the laws of the State of Indiana, without regard to its conflict of laws principles. You and we agree to submit to the exclusive jurisdiction of any State or Federal court located in Marion County, Indiana and you and we hereby waive any jurisdictional, venue, or inconvenient forum objections to such courts.

Other

These Terms of Use contain the entire agreement between you and Citizens Energy Group regarding the use of SMS Texting, and supersede all prior understandings related to use of SMS Texting. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of these Terms of Use, and the remaining portions shall remain in full force and effect.

Minor Carriers: Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central IL (ECIT), Cellular One of Northeast Pennsylvania, Cincinnati Bell Wireless, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Southern Linc, Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless), Cellcom, CSpire Wireless.  

Opt-Out Process: You may opt-out of receiving SMS alerts and notifications by texting the keyword STOP to 56141. Alternately, you may contact Citizens Energy Group at (800) 427-4217 with your request. You may also visit the accounts and notifications portal at https://www.citizensenergygroup.com/ and adjusting your notification preferences.

Automated Voice Alerts

If you enable automated voice alerts, you provide consent for Citizens Energy Group, or a service provider on its behalf, to contact you at the telephone number you provide regarding your Citizens Energy Group account for reasons such as appointment reminders, account information, or work in your area. Your consent allows the use of an automated dialing system to use pre-recorded calls to contact you. You may opt out of this preference by visiting the alerts portal at CitizensEnergyGroup.com or by calling (800) 427-4217. You also agree to Citizens Energy Group’s Privacy Policy

Paperless Billing Alerts

Types of Information to be Provided in Electronic Form
By enrolling in Paperless Billing Alert, you will consent to Citizens Energy Group providing electronically, as described below, (1) your monthly service bill and (2) all disclosures, notices, records, and other types of information related to your utility service (both current and future) that would be included in your Citizens bills.

Paper Copies
Citizens will not be obligated to provide any bills to you in paper form unless you specifically request us to do so. You may obtain a paper copy of your bill by contacting us at 1-317-924-3311.

Withdrawing Consent
You may withdraw your consent to receipt of bills in electronic form in the Paperless Billing section of My Account. We will begin sending bills to you in paper form within a commercially reasonable time after your request.

Method of Providing Electronic Bills
If you consent to receipt of electronic bills we will notify you of the availability of the bills by email using the email address you provide. You will be able to access, view, and print these bills by logging into your online account which can be accessed through the Login link at www.citizensenergygroup.com. By consenting to receipt of the bills in electronic form, as described above, you acknowledge and agree that you are registered and can or will be able to access, read and print the bills.

Hardware and Software Requirements
In order to receive bills electronically, you will need (1) a working connection to the Internet, (2) to be registered at www.citizensenergygroup.com and (3) either a printer to print the bills or sufficient hard drive space available to save the bills (e.g., 1 megabyte or more).

Updating your Records
It is your ongoing responsibility to provide us with an accurate, current, and complete email address. If any electronic bill is not available to you online, we may attempt to contact you by telephone or otherwise.

Citizens’ Option to Send Paper
Your consent does not mean that Citizens must provide all documents electronically. Citizens may, at its option, deliver documents to you in paper form. Citizens may also require that certain communications from you be delivered on paper at a specified address.

Termination/Changes 
We reserve the right, at our discretion, to discontinue the provision of electronic bills. We will provide you with notice of any such termination or change as required by law.
